This Privacy Policy (the “Policy”) describes the types of information we may collect from you or that you may provide when you visit the websites kornerstonecredit.com, portal.Kornerstonecredit.com, and dealers.Kornerstonecredit.com (the “Site(s)”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to the information we collect:

It does not apply to information collected by:

  • Kornerstone offline or through any other means, including on any other website operated by Kornerstone or any third party; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Sites.

If you do not agree with our policies and practices, your choice is not to use our Sites. This Policy may change from time to time, so please check the website each time you use it for the most current information. Any changes to our Policy will become effective upon our posting of the revised Policy on the Site and the use of the Site following such changes constitutes your acceptance of the revised Policy then in effect.

The trust of our customer is our most precious asset. Protecting your privacy and safeguarding your personal and financial information is one of our highest priorities. By leasing or signing an agreement or by using the Sites, you give your consent to the collection and use of personal information by Kornerstone as explained in this statement and to obtaining annual notices of, and changes to, this Policy electronically. Any dispute over our Privacy Policy is subject to this notice and the Kornerstone Lease Agreement, including arbitration of disputes and limitation of damages.

Why We Collect Information

Financial companies choose how they share your personal information. Federal law gives consumers the right to limit some but not all sharing. Federal law also requires us to tell you how we collect, share, and protect your personal information. Please read this notice carefully to understand what we do.

What Information We Collect from Customers

When you visit the Sites, you may provide us with two (2) different types of information: (a) personal information, and (b) non-personal information. We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, and other tracking technologies.
  • From third parties, for example, our business partners.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Personal Information. We may collect the following types of personal information:

  • Information provided by you for purposes of establishing an account with us. For example, you will be required to submit personal information such as your name, address, social security number, date of birth, telephone number, e-mail address and physical address.
  • When you enter an agreement through the Site or at a physical location, we may collect your credit card number or other payment account number, billing address, and information related to such purchases (collectively, “Payment Information”) from you.
  • Other information we collect, such as information used to verify your identity in the even you forget your login information required to access online services.
  • Information you provide us through customer service correspondence and general feedback.

We may share information about you among companies affiliated with us, including with Kornerstone Credit, LLC and its subsidiaries, to inform you about additional products, services or promotions that may be of interest to you. Without your permission, we do not allow third parties to collect personally identifiable information (PII) about your online activities, over time and across different sites, services, and applications, when you use our Sites, service or application.

Non-personal information. Non-personal information includes information:

  • That is about you but does not identify you; and/or
  • About your internet connection, the equipment you use to access our Site, and usage details.

Because non-personal information does not personally identify you, we may use such information for any purpose. In addition, we reserve the right to disclose such non-personal information to other third parties, for any reason.

In some instances, we may combine non-personal information with personal information. If we combine any non-personal information with personal information so that it personally identifies you, the combined information will be treated by us as personal information as long as it is combined.

We may, along with our affiliates and marketing partners enhance and/or merge personal information about you with data collected from other sources and use it in direct and/or online marketing and, to the extent permitted by law, individual reference look-up service programs. In the event we enhance and/or merge such personal information with data collected from other sources, we will take reasonable steps to maintain the integrity and quality of that information.

How do we collect information through automatic data collection technologies?

As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patters, including:

  • Details of your visits to our Site, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Site.

How do we use your information?

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

Do we disclose information to third parties?

  • We may disclose the information that we collect to our affiliated companies to provide the products you request, to enhance our products to better suit your needs, and from time to time for marketing purposes.
  • Business Partners. We may partner with other companies to offer you products or services or to fulfill the products or services that you order. We may disclose personal information and/or non-personal information, or de-identified information collected about you to such third-party partners for the purposes described in this Policy.
  • Service Providers. We work with third parties who provide services including but not limited to data analysis, order fulfillment, list enhancement and other administrative services. We may disclose personal information to such third parties for the purpose of enabling these third parties to provide services to us. Such services may include: marketing distribution, email list management services, advertising, certain product functionalities, customer support, web hosting, customer data management and enhancement, fulfillment services (e.g., companies that fill product orders or coordinate mailings), research and surveys, data analysis, and email service.
  • We reserve the right to transfer any and all information we collect from our customers, via the Sites or otherwise, to an affiliate or third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).
  • Law enforcement; emergencies; compliance; other purposes permitted by law. Notwithstanding any other provision of this Policy to the contrary, we reserve the right to disclose personal information to others as we believe appropriate (a) to comply with legal process; (b) to respond to government requests; (c) to enforce our Terms of Use; (d) to protect the rights, privacy, safety or property of Kornerstone Credit, LLC, our affiliated companies, you or others; (e) to permit us to pursue available remedies or limit the damages that we may sustain; and (f) for any other purpose permitted by applicable law.
  • Aggregate, Non-personal, or De-identified Information. We may share aggregated information (i.e., information about you and other customers collectively, but not specifically identifiable to you) and other non-personal, de-identified, or anonymous information we collect with third parties, including affiliates to develop and deliver targeted advertising on our Site and on the websites of third parties. If you would prefer that we do not utilize cookies with your website experience or would prefer to restrict the use of cookies with network advertising partners, please see the “Your Choices” section below.
  • Information collected through our SMS Program(s) won’t be shared to third parties for marketing purposes.
  • Kornerstone employees have limited access to information based on business need to provide service, and there is no unauthorized access to information by Kornerstone employees.
  • We may disclose personal information for any other purpose disclosed by us when you provide the information.

Your Choices

You have choices when it comes to updating your information, learning about new offers or products offered by us, our partners or affiliates. If you do not wish to receive offers of products from us, our partners or affiliates, here are the methods in which you can opt out:

  • Kornerstone Credit, LLC Commercial Email. If you prefer not to receive emails from us about offers and promotions, please unsubscribe via the unsubscribe link in an email.
  • Cookies and “Do not Track” signals. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular website, to your computer. At this time, we do not respond to ‘do not track’ browser signals. If you disable or refuse cookies, please note that some parts of this site may be inaccessible or not function properly.
  • Changing Information. Corrections or updates to your information including your email address, phone number, mailing address, credit card information or password reminder phrase can be made through the edit profile section of your account on the Site***. If necessary, other corrections or updates to your information can be made by contacting a customer care representative at (888) 521-5111, for your protection, our customer care representatives may request support documents before making any changes or updates to your account.

We will endeavor to comply with your request as soon as reasonably practicable. Please note that if you opt-out as described above, we will not be able to remove personal information about you from the databases of third parties with which we have already disclosed personal information as of the date that we implement your opt-out request. If you wish to cease receiving marketing-related e-mails from third parties, please contact such third parties directly or utilize any opt-out mechanism set forth in their respective privacy policies or marketing-related emails.

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out right may submit a request to this designated email address: cs@kornerstonecredit.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

How do we protect your information?

We have security measures and tools, such as firewalls, in place to help protect against the loss, misuse and alteration of the information under our control. Unfortunately, no data transmission over the internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel the security of any account you might have with us has been compromised), please notify us of the problem as soon as possible by contacting us in accordance with the Section “Contact Us” below (note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem).

A SPECIAL NOTE REGARDING INDIVIDUALS UNDER 18 YEARS OLD

The Site is not directed to individuals under the age of eighteen (18), and we request that such individuals not provide personal information through the Site. We do not knowingly collect personal information from individuals under 18. If you are under 18 years of age, do not use or provide any information on this Site or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive or public comment features of this Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or screen name or username you may use. CHANGES TO OUR PRIVACY POLICY
